Terms and conditions
Our terms and conditions are plain and simple, and avoid legalese as much as possible. Our customers are honest and reasonable, and so are we. In the unlikely event of a dispute, we expect to come to an agreement that is acceptable to both parties, without the need of resorting to juristic unpleasantries.General terms and conditions
In general, we are happy to accept the terms and conditions of our customers. However, we do not accept them automatically. Neither do we expect our customers to accept our terms and conditions automatically. Mutual acceptance of terms and conditions, and any exceptions thereof, must be specified in the contract.
All our prices are excluding 19% VAT. All payments to 59bits must be done by bank transfer to the bank account mentioned on the invoice. We do not accept payment by credit card or check. Except for open courses, all payments must be made within 30 days after the invoice date. The payment conditions for open courses are specified in the next section.
The liability of 59bits is limited to the amount invoiced by 59bits in the matter concerned.
Terms and conditions applicable to open courses
In case of a registration for one of our courses, we will send the customer a registration form in pdf, together with our terms and conditions. This form must be signed by someone authorised to make company purchases (usually someone from the HRM department), and returned to us by mail or, after scanning, by email. A course participant is registered once we confirm the receipt of the signed registration form. Returning the signed form obliges the customer to pay. In case the customer accepts our terms and conditions, he or she must indicate so by checking the appropriate checkbox on the registration form. Otherwise, if case the customer cannot accept some of our terms and conditions, and/or needs us to accept specific terms and conditions of their own, this must be indicated on the registration form as well. Any exceptions and/or additions specified by the customer are accepted by us when we have confirmed the acceptance in writing or by email.
Invoicing for open courses takes place three weeks before the start of the course (or as soon as possible, in case of late registration). Payment must be done within two weeks after the invoice date, but, in case of late registration, at least before the start of the course. If we have not received the payment before the start of the course, we reserve the right to deny the course participant access to the course; this does not lift the customer's obligation to pay for the course.
In case a registered course participant cannot, for whatever reason, participate in the course, the customer may send someone else to take his or her place without additional costs, provided that the customer informs us about the change before the start of the course. In case the customer needs to cancel the course or part thereof, the customer must notify us in writing. Cancellation is subject to the following policy:
- The cancellation date is considered to be the date on which we receive the written cancellation notice from the client.
- In case of cancellation more than 30 days before the start of the course, the customer does not have to pay anything at all.
- In case of cancellation in between 10–30 days (inclusive) before the start of the course, the customer is obliged to pay 50% of the course price.
- In case of cancellation less than 10 days before the start of the course, the customer is obliged to pay the full course price.
59bits reserves the right to change course dates or locations. In case of such changes, the customer has the choice to either accept the change, or to cancel the course without having to pay anything at all.
59bits reserves the right to change course prices. In case of a price increase, a customer who already registered is charged the original (lower) price. In case of a general price decrease, the customer is charged the new (lower) price. The latter case does not apply to promotional discounts, such as last-minute offers.
59bits reserves the right to cancel a course when the number of participants is too small. In this case, 59bits will inform the participants as soon as possible, and the customer will be credited for the full amount payed.
All course materials provided by 59bits are protected by copyright. No parts of the course materials may be reproduced in any form without prior written permission by 59bits.
